Photography Services Contract This agreement for photography services is entered into by you, the “Client”, and Sugarlove Studio, an independent business located in Haddonfield, New Jersey, referred  to as “Studio.”

Booking your session Sessions are booked online. Payments are due in full to secure your spot on the calendar. The studio reserves the right to refuse services/products if the payment arrangements have not been met unless prior arrangements have been made.

Cooperation Studio is not held responsible for behavior of parties involved with the shoot, with the exception of studio personnel. If the desired outcome of your session is jeopardized by the behaviors of parties involved with the exception of studio personnel, studio cannot be held responsible.

Client Usage Rights/Copyrights There will be limited copyright ownership of purchased images delivered via digital download under these conditions: Commercial use of these photos is prohibited. These images are for personal use only, and may be reproduced for the purpose of sharing with friends and family. In the event that these photos will be published, sold for profit, used within marketing materials the client must obtain written permission from and compensate studio prior to the release. Additional contract will be needed at that time.

Studio Usage Rights/Copyrights Client grants studio unrestricted usage rights and copyrights to use and publish photographs in any manner or medium. Client grants studio permission to use images taken within this session in sample albums, marketing materials, editorial, online web presences, including but not limited to, website, social networks, blog, etc. Images may also be used in photographic competitions and for publication in which case the client will release all profits from images. 

Reschedule Policy In the event that the weather conditions are inclement for the shoot based on studio recommendations, the session will be rescheduled. Due to liability and equipment damages this decision will be at studio discretion. If session is rescheduled for any reason in less than 48 hours notice, a $75 reschedule fee will be charged.

Cancellation Policy The session credit may be transferred to another date, but is non-refundable if cancelled completely.

Image Selection Process The photographer will use their professional discretion in choosing from the images taken at your session for presentation in the gallery.  All images in your gallery will be custom edited to represent to photographer’s style.  Full sessions packages are - 12 or 15 images // Mini sessions packages are - 3, 5, 8 or 10 images.

After Your Session Client will be contacted as soon as gallery is available, within 10-21 days of your session. Gallery will be up for 14 days.

Limit of Liability In the unlikely event that the photographer is injured or becomes too ill to photograph the session, studio will make every effort to secure a replacement photographer unless otherwise specified by the client.  If the situation should occur and a suitable replacement is not found or accepted, a reshoot will be scheduled for the next available time slot. In the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond studio control, studio liability is limited to the return of all payments received for the portrait session.  The limit of liability for a partial loss of originals will be a prorated amount of the exposures lost based on the percentage of total number of originals.

Applicable Law The laws of the State of New Jersey in Camden and any applicable Federal Law shall govern this contract.

Release of Liability for Communicable diseases

Sugarlove Studio is following these enhanced procedures to prevent the spread of COVID-19:

• Your photographer will wear the following protective gear: PPE mask/face covering.  All adults except while being photographed will also wear one.
• Hand washing following CDC guidelines at the start of sessions and use antibacterial sanitizer throughout sessions.
• All props, surfaces and fabrics will be sanitized thoroughly with hospital grade disinfectant before and after each session according to the manufacturer's directions, and sterilized with a UV ozone lamp.

By signing below, I agree to each statement above and release Mindy Sorasky and Sugarlove Studio from any and all liability for the unintentional exposure or harm due to COVID-19.

Force Majeure Provision

Neither party shall be liable for any costs or damages due to delay or nonperformance under this Agreement arising out of any cause or event beyond such Party’s control, including but not limited to Acts of God, fire, flood, explosion, earthquake, or other natural forces, war, civil unrest, accident, work stoppage, power or other mechanical failure, governmental action, or communication disruption. A Party claiming the benefit of this provision shall, as soon as reasonably practicable after or during the occurrence of any such event, (a) provide written notice to the other Party of the nature and extent of any such Force Majeure condition; and (b) use commercially reasonable efforts to remove any such causes and resume performance under this Agreement, as applicable, as soon as reasonably practicable.
